"Costa to get 10 minutes of argument time today On Saturday, the Ninth Circuit issued an order (it is not yet up on their website) giving Costa 10 minutes of time, and the secretary of state 20 minutes of time."
Interesting, in that the Attorney General is only arguing procedure (res judicata) and balance-of-burden points in his brief (for Secretary of State Shelly). Could this mean that the 9th is more interested in these issues than Costa's refutation of the 3-judge panel's "Bush v Gore" claims?
Then again, considering that the Attorney Geenral wanted to have the whole 30 minues for himself, this might only mean that the 9th thought Costa should be heard.
